Use & Occupancy

Compensation a former tenant may owe for staying past the end date or after an Order of Possession—calculated by the RTB, often using prior rent as a proxy. It’s not “rent” but payment for holding the unit. It is generally in the landlord's interest to issue use & occupancy receipts in the event a tenant is overholding, as they may otherwise inadvertently re-establish the tenancy with the tenant.
