Savage v. Lu, 2025 BCSC 355

Issue: Upholding a possession order after a tenant withheld rent over alleged disrepair

Bright Law acted for the landlord in this matter. The tenant had withheld rent, claiming the property was unsafe and required maintenance including the removal of several trees, and then disputed the resulting notice to end the tenancy for unpaid rent. Our client obtained an order of possession, which was enforced with the assistance of court bailiffs. The tenant later applied to set aside that order and regain possession, which the Supreme Court declined to do. Success here meant defending our client's order of possession through both enforcement and the tenant's subsequent challenge, bringing a prolonged dispute to a close.
