Naderi v. Cheng, 2026 BCSC 861

Issue: Setting aside a 12-month compensation award against a landlord where the arbitrator's reasons failed to explain the outcome.

Bright Law acted for the landlord in this judicial review. After purchasing a North Vancouver property, our client's family member moved into the home, but the tenants brought a claim for compensation equal to twelve months' rent, arguing the stated purpose for ending the tenancy had not been met. The arbitrator found against our client without explaining why she rejected the testimony of six witnesses, including the family member, a neighbour, and a contractor. We persuaded the Court that reasons which do not allow the parties to understand how and why a decision was reached cannot stand, even under the deferential patent-unreasonableness standard. The decision was set aside and the matter returned to the Branch for a fresh hearing before a different arbitrator.
