Exclusive jurisdiction

All residential tenancy matters in BC must go through the RTB before court, unless you are claiming for general damages in excess of $35,000.00, or compensation for a landlord not fulfilling their obligations after they issue a two, three, or four month notice to end tenancy for landlords use. If you are wondering if you have the option to bring your claim in front of the small claims court instead of the Residential Tenancy Branch, you unfortunately don’t have that choice most of the time.
