How a tenancy ends
Only the methods listed in the Act are valid (mutual agreement, proper notices, orders, frustration, etc.). Section 44(1) sets out that a tenancy only ends if a tenant or a landlord give notice to each other according to the RTA (for example to end the tenancy for unpaid rent or cause), if the tenancy is a fixed term tenancy that requires the tenant to move out at the end of the tenancy (validly, not just for any reason), the landlord and tenant agree in writing to end the tenancy, the tenant abandons or vacates the unit, because the tenancy agreement is frustrated, the director orders the tenancy is ended, or because the agreement is a sublease agreement.
