Fixed-Term Tenancy – Must Vacate
Special cases where a tenant must move out at the end of a fixed-term lease (for example, if the landlord or their family will move in). The RTB treats these clauses as mutual agreements to end tenancy which are validly negotiated, and while a landlord does not need to pay one month’s rent as compensation as they would if they issued a landlords use notice pursuant to section 49, they are still required to move into the property within a reasonable period of time and occupy it for a minimum of six (6) months.
