Forwarding address rule

Landlords can retain deposits until tenants provide a forwarding address; once provided, strict timelines apply. Section 38(1) requires a landlord to return the security deposit on the date the tenancy ends, or the date the landlord receives the tenant’s forwarding address in writing, whichever is later. If that deadline is missed, then a tenant is generally entitled to receive double the security deposit back (per s. 38.1) by bringing a direct request application.
